Terms of Service for Vayazo

Please read these Terms of Service ("Terms") carefully before using the Vayazo application or website (the "Service") operated by Vayazo ("we", "our", or "us").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you may not use the Service.
1. Introduction
Vayazo is a platform that enables users to interact with AI-powered voice avatars and create custom AI voice avatars. These Terms govern your use of our Service.
2. Privacy Policy
Your use of the Service is subject to our Privacy Policy, which outlines how we collect, use, and protect your data. By using Vayazo, you consent to the data practices described in our Privacy Policy, including the processing of voice data through third-party AI providers. 3. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for safeguarding your login credentials and agree not to share your password with others. Notify us immediately of any unauthorized access or security breach.
4. Use of the Service
You agree to use the Service only for lawful and appropriate purposes. Prohibited uses include:    a. Violating any applicable law or regulation.    b. Recording conversations without proper consent from all parties (where required by law).    c. Using the Service to process confidential, classified, or legally protected information without authorization.    d. Transmitting unauthorized advertising or spam.    e. Impersonating Vayazo, its team, or another user.    f. Infringing on the rights of others, including privacy and intellectual property rights.    g. Introducing malware or other harmful code.    h. Using bots or scrapers to access the Service without permission.    i. Attempting to reverse engineer or circumvent our subscription billing system.
5. Voice Data and Local Storage
By using our AI voice avatar services, you acknowledge that:    a. Voice data is processed ephemerally by third-party AI providers and not stored on our servers.    b. Custom AI voice avatars and interaction data are stored locally on your device.    c. You are responsible for backing up your local data if desired.    d. We cannot recover your avatars or data if you lose access to your device or delete the app.    e. You must comply with all applicable laws regarding voice recording and processing in your jurisdiction.
6. Intellectual Property
All content and features of the Service, excluding user-generated AI voice avatars, are the intellectual property of Vayazo and its licensors. You retain ownership of your custom AI voice avatars stored locally on your device. You may not reuse, reproduce, or distribute our app content without permission.
7. Subscription Billing
Our Service operates on a subscription-based model:    a. Fees: You agree to pay the applicable subscription fees for access to AI voice avatar interactions and custom avatar creation as displayed in the app.    b. Billing: Charges are processed via your selected payment method on a recurring basis (e.g., monthly or annually) based on your chosen subscription plan.    c. Cancellation: You may cancel your subscription through the app settings or by contacting us at contact@vayazo.com. Cancellation will take effect at the end of the current billing cycle.    d. Refunds: Subscription fees are generally non-refundable, except as required by law or in cases of technical failure on our part.    e. Pricing Changes: We may update subscription pricing and will provide 30 days’ notice for existing users.
8. Service Availability
While we strive for high availability, we do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:    a. Scheduled maintenance    b. Third-party provider outages    c. Technical issues or emergencies    d. Force majeure events
9. Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may delete your account through the app settings or by contacting us at contact@vayazo.com. Upon termination:    a. Your locally stored data remains on your device.    b. Your subscription will be canceled, and you will not be charged for future billing cycles.    c. Provisions such as intellectual property and limitations of liability will survive termination.
10. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee:    a. The accuracy or performance of AI voice avatars.    b. The availability of the Service at all times.    c. That the Service will meet your specific requirements.    d. That AI voice interactions will work perfectly in all conditions.Use the Service at your own risk.
11. Limitation of Liability
To the maximum extent allowed by law, Vayazo is not liable for:    a. Indirect, incidental, or consequential damages.    b. Loss of data stored locally on your device.    c. Damages arising from inaccuracies in AI voice interactions.    d. Business losses or missed opportunities.Our total liability shall not exceed the amount you paid us in the previous 12 months.
12. Governing Law
These Terms are governed by the laws of the United States. Any legal dispute will be resolved in the courts of the United States.
13. Changes to Terms
We may update these Terms at any time. Material changes will be announced via email or in-app notification with at least 30 days’ notice. Continued use of the Service after changes means you accept the new terms.
